Terms of Service
These terms are an agreement between your business and Valley Digital Services of Iringa, Tanzania, which operates Kendrix POS ("Kendrix", "we", "us"), for the use of the Kendrix POS website and business management platform (the "Service"). By creating an account or using the Service, you agree to these terms on behalf of your business. If you do not agree, please do not use the Service.
1. Who can use Kendrix
The Service is for businesses. You must be at least 18 years old and have authority to accept these terms for the business you register.
2. Your account and your team
- Give accurate information when you sign up, and keep it up to date.
- Keep passwords private. Each person should have their own login; the owner decides what each staff account can see and do.
- You are responsible for activity under your business's accounts. Tell us straight away at info@kendrixpos.co.tz if you think an account has been misused.
3. Free trial, plans and payment
- New businesses get a 14-day free trial. To keep using the Service afterwards, choose a paid plan.
- Plans, prices and any promotional offers are shown on our pricing page and apply as described there. Promotional offers apply only to the period and plans they state.
- Fees are due in advance for each billing period. If payment is overdue, we may limit access after giving you notice; your data is kept while you sort it out.
- We may change prices with at least 30 days' notice. New prices apply from your next billing period.
4. Your data
- Your business records belong to you. You can export them at any time.
- You give us permission to store, process and display your records only as needed to provide, secure and support the Service. Our Privacy Policy explains how we handle data.
- When you record information about your customers, staff or suppliers, you are responsible for having the right to do so and for telling them how you use it, as the law requires.
- Check important figures before acting on them. The Service helps you keep records but does not replace your own accounting, tax or legal obligations.
5. Acceptable use
You agree not to:
- use the Service for anything illegal or fraudulent;
- try to access another business's data, other people's accounts, or parts of the Service you are not allowed to use;
- attack, overload, probe or disrupt the Service, or get around its security or usage limits;
- copy, resell or reverse-engineer the Service, except where the law allows;
- upload malicious code or content that infringes other people's rights.
We may suspend accounts that break these rules, and we will tell you why unless the law or security prevents it.
6. AI Advisor
The AI Advisor gives automated suggestions based on your figures. Answers can be incomplete or wrong, and they are not financial, tax, legal or professional advice. You decide what to do with them. The Privacy Policy explains what is sent to AI providers.
7. Availability and support
We work to keep the Service available, secure and backed up, but we cannot promise it will always be uninterrupted or error-free. We may need short breaks for maintenance and updates, and we may improve or change features over time. For help, use Support in the app or email info@kendrixpos.co.tz.
8. Ending your use
- You can stop using the Service at any time. Export your records first if you want to keep a copy.
- We may suspend or close an account for serious or repeated breaches of these terms, or for non-payment after notice.
- When an account is closed, we delete its data as described in the Privacy Policy.
9. Liability
The Service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits, lost sales or lost data, and our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. We will change the date at the top and, for important changes, tell account owners by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the United Republic of Tanzania, and the courts of Tanzania have jurisdiction over any dispute.
